These Terms of Service ("Terms") govern your use of flowerpreserves.com (the "Site") and any purchase, booking, or custom order placed with Dalia's Luxury Flower Preservation and Botanical Art ("Dalia's," "we," "us," or "our"). By accessing the Site, placing an order, paying a deposit, or sending us flowers, you agree to these Terms, our Return and Refund Policy, Shipping Policy, and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Site or place an order.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order, you confirm that the information you provide is accurate and complete and that you are authorized to use the payment method provided.

2. Our Products and Services

We offer (a) custom preservation services, in which we preserve flowers and botanicals you provide and incorporate them into resin art, furniture, or décor; and (b) ready-made pieces created by our studio. Every piece is handmade and one of a kind. Photos, mock-ups, and samples on the Site are representative only; your piece will vary in color, layout, flower placement, size of individual elements, and finish.

3. Custom Orders

  • Booking and deposit. A custom order is confirmed only when we accept it in writing and receive your deposit. Deposits are non-refundable as described in our Return and Refund Policy.
  • Design approval. Where we provide a design proposal or mock-up, your approval authorizes us to proceed. We reserve artistic discretion over final arrangement, flower selection, and composition.
  • Timelines. Completion times are good-faith estimates, not guarantees. Drying and curing depend on flower type, moisture, weather, and studio volume. We are not liable for delays.
  • Flower selection. We select the best-preserving blooms from what you send. Not every flower will be used, and we may supplement with complementary botanicals of our choosing unless you instruct otherwise in writing.
  • Unused flowers. Unless you request their return in writing before work begins (shipping at your cost), unused flowers and botanicals may be retained or discarded at our discretion 30 days after your piece is completed.
  • Final payment and pickup. Your remaining balance is due before your piece ships or is picked up. Unpaid or unclaimed pieces are handled as described in our Return and Refund Policy.

4. Your Flowers and Materials

By sending us flowers, keepsakes, or other materials, you represent that you own them or have the right to provide them, and that they do not contain pests, hazardous materials, or anything unlawful. You authorize us to cut, dry, press, treat, alter, and permanently encapsulate them. Preservation is an irreversible process. Flowers and botanicals are perishable natural materials, and we cannot guarantee their color, shape, or condition after preservation. We are not responsible for items included with your flowers that are not part of the order (such as jewelry, ribbons, or containers) unless we agree in writing to incorporate or return them.

5. Pricing and Payment

  • All prices are in U.S. dollars and may change at any time without notice. The price in effect when your order is confirmed applies.
  • We reserve the right to correct pricing, description, or availability errors, and to cancel or refuse any order, including after it is placed. If we cancel a paid order due to our error, we will refund the amount paid.
  • You are responsible for applicable sales taxes, duties, and shipping charges.
  • Quotes for custom work are valid for 30 days unless stated otherwise.

6. Shipping, Risk of Loss, and Delivery

Risk of loss for finished pieces passes to you upon delivery to the carrier, except as provided in our Return and Refund Policy for damage reported within 48 hours of delivery. Risk of loss for flowers you send to us remains with you until we receive them. Large items and furniture may require freight delivery; you are responsible for providing accurate delivery information and access.

7. Use, Care, and Safety

  • Resin pieces are decorative unless expressly described otherwise. They are not food-safe unless stated in the product listing, and should not be exposed to direct heat, hot items, open flame, or prolonged direct sunlight or UV light.
  • Resin may yellow, and botanicals may fade or change color, over time. This is a natural characteristic of the materials and is not a defect.
  • Tables and furniture must be used within any stated weight limits and on stable, level surfaces. Pieces may be heavy; use care when lifting, mounting, and installing. Wall art must be hung with hardware rated for its weight.
  • Keep small pieces away from young children and pets.
  • Follow the care instructions provided with your piece. We are not responsible for damage or injury resulting from misuse, improper care, installation, or modification.

8. Intellectual Property and Photography

  • All Site content, designs, compositions, photos, text, logos, and branding are owned by Dalia's and protected by copyright and trademark law. You may not copy, reproduce, or use them without our written permission.
  • Purchasing a piece gives you ownership of the physical item only. We retain all intellectual property rights in our designs and artwork.
  • You grant us a perpetual, royalty-free right to photograph and video your finished piece and the preservation process and to use those images for portfolio, marketing, social media, and advertising. We will not publish your name or personal details without your consent. To opt out, notify us in writing before your piece is completed.
  • If you send us photos, invitations, or other materials to include in a piece, you confirm you have the right to use them and grant us permission to reproduce them for your order.

9. Reviews and Submissions

Reviews, comments, photos, and other content you submit must be truthful and lawful. You grant us a non-exclusive, perpetual, royalty-free license to use, display, and share them. We may remove content at our discretion.

10. Prohibited Uses

You may not use the Site for any unlawful purpose; to infringe on others' rights; to submit false information or fraudulent orders; to interfere with the Site's security or operation; or to scrape, copy, or resell our content or products without permission.

11. Third-Party Services

The Site is hosted on Shopify and may use third-party payment processors, carriers, and apps. Your use of those services is subject to their terms. We are not responsible for third-party websites, services, or carriers.

12. Disclaimer of Warranties

Except as expressly stated in these Terms or our Return and Refund Policy, the Site, products, and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific aesthetic outcome, color, or longevity of preserved botanicals.

13. Limitation of Liability

To the fullest extent permitted by law, Dalia's and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of sentimental, emotional, or replacement value, arising from your use of the Site or any order. Our total liability for any claim relating to an order, including loss of or damage to flowers or materials you provide, will not exceed the amount you paid for that order.

14. Indemnification

You agree to indemnify and hold harmless Dalia's and its owners, employees, and contractors from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law or third-party right, materials you provide to us, or your misuse of any product.

15. Force Majeure

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, extreme weather, power or supply outages, carrier delays, illness, labor shortages, pandemics, or government action.

16. Dispute Resolution

If you have a concern, please contact us first; most issues can be resolved quickly and informally. If a dispute cannot be resolved within 30 days of written notice, it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and Dalia's each waive the right to a jury trial and to participate in a class action or class arbitration. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to Section 16, any action will be brought exclusively in the state or federal courts located in Orange County, California.

18. Changes to These Terms

We may update these Terms at any time by posting the revised version on the Site. The Terms in effect when you place an order apply to that order. Continued use of the Site after changes are posted constitutes acceptance.

19. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver. These Terms, together with the policies referenced above and any written order confirmation or design approval, are the entire agreement between you and us. In the event of a conflict, a signed custom order agreement controls over these Terms. You may not assign your rights under these Terms without our consent.
